REGULAR SESSION - APRIL 12, 1999

The Board of Island County Commissioners (including Diking Improvement District #4) met in Regular Session on April 12, 1999, beginning at 9:30 a.m., in the Island County Courthouse Annex, Hearing Room, Coupeville, Wa., with Mike Shelton, Chairman, Wm. L. McDowell, Member, and Wm. F. Thorn, Member, present. Minutes from the meetings of March 9, 10 and 15, 1999 were approved and signed.

Hiring Requests & Personnel Actions

Dick Toft, Director, Human Resources, presented for Board action Personnel Action Authorizations, briefly reviewing each.

With regard to PAA # 041/99, Sheriff Hawley requested waiver of delayed hiring policy [based on 50% leave buy-out] and authorization to hire May 1, 1999 rather than having to wait until May 17th, equating to $1250. The case the Sheriff made was that with a position already unfilled and the need to cover the Jail, should this position not be filled when incumbent vacates the position May 1st, overtime would be required to provide sufficient coverage in the Jail. The Sheriff can cover the funds required now from his budget, but he thought it was too early in the year for him to be able to commit that he would not end up short at the end of the year. Commissioner McDowell thought if the Sheriff’s Budget was $1250 over at the end of the year, that would not be a problem.

Chamber of Commerce

Having received favorable recommendations from the Island County Sheriff and the Health Department, the Board by unanimous motion forwarded a recommendation of approval to the Washington State Liquor Control Board for Special Occasion Liquor License #071962 by the Langley Chamber of Commerce for April 24, 1999 sailing to Everett out of Langley.

Island County Contracts for 2% Hotel/Motel Tax Revenues

for the 1999 Tourism Program Year

In accordance with the Board’s approved projects and activities February 22, 1999, funded by 2% tax revenues, the Board approved, on unanimous motion, follow-on contracts with various organizations [those contracts that have been signed by the various organizations at this point; one remaining] :

Central Whidbey Chamber of Commerce $ 8,000

Concerts on the Cove $ 1,500

Lighthouse Environmental Programs, WSU Beach Watchers $ 2,000

North Whidbey Lions Club $ 3,500.

Contract #HS-06-98, Island County and the Stanwood/Camano Family Center, Substance Abuse Prevention Mini-grant

By unanimous motion, the Board approved health contract #HS-06-98, between Island County and the Stanwood/Camano Family Center, a Substance Abuse Prevention Mini-grant in the amount of $2,500.

Signature on Escrow Papers for Sale of Seized property

Lee McFarland, Assistant Director GSA/Property Management, presented for approval and signature, notice of compliance and closing agreement and escrow associated with sale of seized property [Freeland area]; full disclosures have been made, reviewed and signed off by Dave Jamieson, D.P.A.

The Board, by unanimous motion, authorized the approval and signing of Escrow papers for the selling Prosecuting Attorney’s seized property, including Questionnaire, Notice of Compliance with A.P.R. 12, Escrow No. SW-4730, and Closing Agreement and Escrow Instructions.

Resolution #C-39A-99 (R-18-99) Initiating CRP 99-04, Camano Island MISCELLANEOUS ACP Overlays 1999

By unanimous motion the Board approved Resolution #C-39A-99 (R-18-99) Initiating CRP 99-04, involving a project on Camano Island to lay by contract, ACP Overlays during 1999, at an estimated cost of $390,000.

Commissioner Thorn indicated his interest in assessing with the Public Works Director and County Engineer the possibility of having County staff do the work versus contracting out.

RESOLUTION #C-40-99 [R-19-99] INITIATING CRP 99-03, WHIDBEY

ISLAND MISCELLANEOUS ACP OVERLAYS 1999

By unanimous motion, the Board approved Resolution #C-40-99 [R-19-99] Initiating CRP 99-03, Whidbey Island miscellaneous ACP Overlays for 1999, at an estimated cost of $472,000, by contract construction.

Commissioner Thorn again indicated his interest in assessing with the Public Works Director and County Engineer the possibility of having County staff do the work versus contracting out.

Resolution #C-41-99 (R-21-99) – Approve specs & authorize call for bids for 1999 ACP Overlays – Camano Island, CRP 99-04

By unanimous motion, the Board approved Resolution #C-41-99 (R-21-99) Approving Specifications and Authorizing Call for Bids for ACP Overlays – Camano Island, under CRP 99-04, Work Order 275, with bid opening scheduled for May 20, 1999 at 11:00 a.m., in Meeting Room 4, Courthouse Annex, Coupeville.

WSDOT Agreement GCA 1469 – construction of intersection improvements SR 20/Banta Road/Northgate Drive

Mr. Kwarsick presented for approval, Washington State Department of Transportation Agreement GCA 1469 representing the County’s financial participation in construction of intersection improvements at SR 20/Banta Road/Northgate Drive, a project total estimated cost of $1,192,526 and the County’s financial participation not to exceed $597,000. Lew Legat, County Engineer, explained that this was one of the intersections within the high accident corridor on Highway 20 going north and is recognized by the State in need of improvements. From the County intersection with Highway 20 this intersection does have some problems. Mr. Kwarsick pointed out that based upon the Transportation Plan, this stretch of highway is one of the more troublesome areas in terms of maintaining level of service standards, in addition to safety improvements.

By unanimous motion the Board approved Washington State Department of Transportation Agreement GCA 1469 representing the County’s financial participation in construction of intersection improvements at SR 20/Banta Road/Northgate Drive, as presented.

Supplemental AGreement #1–amendING #PW-972033, Central Whidbey Trails Council; property management in Kettles area

As presented and recommended for approval by Mr. Kwarsick, the Board approved Supplemental Agreement #1, amending Agreement #PW-972033, Central Whidbey Trails Council providing property management in the Kettles area extending the term of agreement to 3/9/2001. The Board

acknowledged the services and expressed sincere appreciation for the Central Whidbey Trails Council, all volunteer work.

Quitclaim Deed – RIGHT-OF-WAY FOR Woodland Beach Road repair

The Board, on unanimous motion, accepted on behalf of Island County, a Quitclaim Deed from Daniel J. and Carolyn L. Tores, and authorized payment for same in the amount of $4,154.00, for right-of-way associated with Woodland Beach Road repair, Parcel #190.335, Sec. 3-31-2E.

DRAINAGE/CONSTRUCTION EASEMENTS-LOTS 21, 22 AND 23

PLAT OF WOODLAND BEACH

The Board, on unanimous motion, approved three drainage easements and three construction easements from Ruth M. and Roy E. Lambert, Camano Island, Lots 21, 22 and 23, Plat of Woodland Beach, under Work Order #184.

Resolution #C-43-99 [PLG-008-99] Extending service area for the North Whidbey Water District and updating the Coordinated Water System Plan to reflect the service area expansion

Phil Bakke, Comprehensive Plan Manager, Island County Planning Department, presented Resolution #C-43-99, which if approved, would extend the service area for the North Whidbey Water District and update the Coordinated Water System Plan to reflect the service area expansion to include Parcel #R13435-249-2730 by Chris Kelly, owner. The property is approximately .94 acres in area and is a triangular parcel historically used in conjunction with light tourism and service retail business activity, in the area of Deception Pass, where Bob’s Produce Stand previously was located. The property is classified Rural Village in the Island county Zoning Atlas. The owner of the parcel worked with the District to expand to serve that vacant parcel, and the District submitted an application accepted by the County March 2, 1999, proposing to extend the water service area to the one additional lot abutting the west side of State Highway 20 on Assessor’s Parcel #R13435-249-2730.

Mr. Bakke confirmed that the request did not include any proposed expansion of service area. The Washington State Department of Health in a March 12, 1999 letter reported no objection to the proposed extension. The Island County Public Works Department in an April 2nd memo advised of no objections to approval of the expansion, subject to a number of conditions listed in that memo, attached to the Resolution as Attachment "A". With that, the Planning Department recommended approval. Reviewing with the Board the Water Service Area Map in the application, Mr. Bakke showed that the map detailed the whole service area and proposed service area.

By unanimous motion, the Board adopted Resolution #C-43-99 [PLG-008-99] extending the service area for the North Whidbey Water District and updating the Coordinated Water System Plan to reflect the service area expansion to include Parcel #R13435-249-2730.

WHEREAS, the North Whidbey Water District has prepared and an application for a service area expansion per the Island County Coordinated Water System Plan, RCW 70.116, and WAC 248-56; and

WHEREAS, the water system plan and existing service area of the North Whidbey Water District has been reviewed for consistency with the Island County Comprehensive Plan, the Island County Coordinated Water System Plan, and other applicable State and local codes and regulations.

WHEREAS, the Island County Public Works Department recommends conditional approval of the North Whidbey Water District service area expansion (conditions listed in Attachment "A").

WHEREAS, the Washington State Department of Health does not object to approval of the North Whidbey Water District service area expansion.

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Board of Island County Commis-sioners that the proposed service area expansion for the North Whidbey Water District be incorporated into the Island County Coordinated Water System Plan subject to the conditions from the Island County Public Works Department listed in Attachment "A".

DONATION by Local Chapter of MADD

Jo Hellmann, President, Local Chapter of MADD, presented to the Island County Sheriff, Mike Hawley, 12 Portable Breath Testers, and to Bill Overby, Deception Pass State Park Ranger, 2 Portable Breath Testers. Each PBT costs just over $400 with the mouthpieces and tax.

Sheriff Hawley pointed out that Island County and its citizens should be really proud of the local chapter of MADD, recognized State-wide as one of the most active organizations in the State.

Mrs. Hellmann felt that the PBT’s were small tools doing a big job: a PBT can be the final conclusive piece of evidence to get a drunk driver off the road, and makes a case that much harder to beat once it goes to court. She commented that the donation would not be possible without local citizens, businesses and organizations who donate to MADD, noting that Island Thrift donated $3,000. Other PBTs will be donated to the Washington State Patrol, Oak Harbor Police Department, Coupeville Police Department and NAS Security, for a total of 23 units donated by MADD throughout Island County.

On behalf of the citizens of Island County, Board members extended a heartfelt thanks to Mrs. Hellmann and MADD for the wonderful donation of the Portable Breath Testers.

EXECUTIVE SESSION

The Board met in Executive Session at 1:00 p.m. as allowed under R.C.W. 42.30.110(1)(g), to

interview four Board of Equalization candidates. The Chairman estimated that the session would last until approximately 3:00 p.m., and no announcement would be made today. The Board will, however, announce the final selection at a future meeting open to the public.

There being no further business to come before the Board, the Chairman adjourned the

meeting at 3:00 p.m. on conclusion of the Executive Session.
