NOVEMBER 8, 1999
The Board of Island County Commissioners met in
Special Session on November 8, 1999, at 7:00 p.m. at Country Club Fire Station,
1326 S. Elger Bay Road, Camano Island WA.
Chairman Shelton, Commissioners McDowell and Thorn were present. Lew Legat, Island County Engineer and nine
citizens were also present.
PUBLIC HEARING TO CONSIDER ORDINANCE C-129-99 (R-40-99) ESTABLISHING PARKING RESTRICTIONS ON MAPLE GROVE ROAD, CAMANO ISLAND, IN THE VICINITY OF THE MAPLE GROVE BOAT RAMP AND AMENDING CLERICAL
ERROR IN ICC 10.06.030
Chairman Shelton opened a Public Hearing as scheduled
at 7:00 p.m. to consider Ordinance C-129-99 (R40-99) Establishing Parking
Restrictions on Maple Grove Road, Camano Island, in the Vicinity of the Maple
Grove Boat Ramp and Amending Clerical Error in ICC 10.06.030.
Lew Legat, Island County Engineer, explained
approximately 10 years ago, the County purchased property adjacent to the Maple
Grove boat ramp for a public parking facility.
He commented a lot of people use the boat ramp which has created some
parking problems. The Maple Grove area
is a densely compacted area with small lots with severe topography which
restricts parking. People using the
boat ramp sometime park in front of the homes when the public parking facility
is full. The County has been working
with the community to resolve the parking problems studying issues such as
drainage and slope stability. As a
result the County has proposed to limit parking on the south side of Maple Grove Road to residents only for lots
37 through 45 of Maple Grove Beach, Division 2, and Lots 34 through 36 of Maple
Grove Beach; not reserving any particular parking place within this zone for a
resident. Parking on the north (water)
side of Maple Grove Road would be restricted altogether from there all the way
to North Camano Drive. He explained the
road was only 18 to 20 feet wide and there were not adequate shoulders to park
off the right of way. He further explained
there was a slide area along part of the road.
Darryl Thomas, 633 Maple Grove Road, stated he owned
lots 32 and 33 of Maple Grove Beach and would like them included in the
“resident only” parking restrictions.
He explained he had been working toward a solution for the limited parking
for the last three years. A small slide
had eliminated his parking space and he had proposed building a bulkhead to
create a parking space, but wanted to be assured he would be able to park
there. The County had said he could not
restrict public parking there. The
parking space he would create would be off the pavement, but not on his
property. He had a survey completed
after the slide which indicated his property line was half way up the bank to
his cabin which changed his plans for building the bulkhead on his
property. He understood the County
could turn the property over to him so he would incur the cost of the
bulkhead. He was also concerned about
the liability portion.
Mr. Legat explained the parking ended at lot 34 and
that was why the proposed Ordinance excluded his lots, but the Ordinance could
be amended to include his lots. He
stated the County could issue a permit to work in the County right of way to
construct the bulkhead, but they would not be able to reserve the parking space
just for his use. He would have to share
the parking with the other residents.
Robert Loken, 851 N. Sunset Drive, asked where did
the funds come from to maintain the boat ramps and parking areas. He asked if this ramp had the same
commercial restrictions as the Utsalady boat ramp did?
Commissioner Shelton explained the funds came from
the Current Expense Fund allocated to the Parks Department to maintain park
lands throughout Island County.
Gail Campbell, 657 Maple Grove Road, asked if the
ordinance could be amended so she could park her small boat and trailer or her
friend’s small boat trailer in the resident’s only parking space because they
can’t keep it at the boat launch overnight.
Commission McDowell asked since Mr. Thomas had lost
his parking space, would there be enough room for him to park along with the
small boat trailers? He asked if the
neighbors would be able to police themselves so it would be fair for everyone?
Commissioner Thorn suggested they could amend the
ordinance to only restrict the parking of recreational vehicles and large
vehicles and remove the reference of boats and trailers. He commented he had a lot of people coming
into his office concerned about the parking problems and he wanted the best
solution for everyone concerned.
Mr. Thomas commented that the residents were told
they could request permission from Mr. Lee McFarland, Parks Department to park
in the pubic parking facility overnight if they anticipated they would need
additional overnight parking for themselves or guests.
Mr. Legat explained the residents would be issued
plastic resident parking permit cards which would need to be placed in the dash
of the vehicle to alert the Sheriff.
The County would be posting signs that said “Resident Parking Only
Between Signs” and “No Parking” signs would be placed on the north side of the
road and on the east side to North Camano Drive.
Linda Baumgartner, 657 Maple Grove Road, asked if
their guests did not have parking permit cards in their vehicle, would they get
ticketed from the Sheriff’s Department?
Chairman Shelton explained that they would have an
extra parking permit card to loan to their guests to be able to park
there.
Commissioner Thorn moved to approve Ordinance No.
C-129-99 (R-40-99) as proposed with the following changes: In the 6th Whereas paragraph, of
the Ordinance change Lot 34 to lot 32 of Maple Grove Beach; in the 7th
Whereas paragraph change Lot 34 to Lot 32; and in Exhibit A in paragraph one,
change Lot 34 to Lot 32; and in paragraph two change Lot 34 to Lot 32 and also in
that paragraph delete the words “boats and trailers” so that it reads
“Residents are prohibited from parking recreational vehicles and other large
vehicles thereon.” Motion was seconded
by Commissioner McDowell, and carried unanimously.
WHEREAS, the County’s Maple Grove boat ramp is a limited use facility, with limited parking opportunities, which is experiencing over use; and
WHEREAS, the existing parking demands exceed the capacity of the Maple Grove boat ramp facilities and users are parking on Maple Grove Road right-of-way reducing the parking opportunities for the immediate Maple Grove resident community; and
WHEREAS, parking practices on Maple Grove Road are impeding safety and interfere with free movement of traffic thereon; and
WHEREAS, ICC 10.06.020, WAC 308-330-270(5), WAC 308-330-462, and RCW 46.61.575(4) authorize the Board of County Commissioners to place traffic control devices prohibiting, limiting, or restricting the stopping, standing, or parking of vehicles on any roadway where it is determined that such parking stopping, standing, or parking is dangerous to those using the roadway or where same would unduly interfere with the free movement of traffic thereon; and
WHEREAS, Maple Grove Road is a two lane narrow road with no shoulder and has an area of an embankment slide, thus when vehicles are parked along this portion of the roadway within this area, they are partially parked on the traveled way, creating a traffic safety hazard and interfering with free movement of traffic; and
WHEREAS, the County recognizes that a “Resident Only” parking area is needed on Maple Grove Road fronting Lots 37 through 45 of Maple Grove Beach Division #2 and Lots 32 through 36 of Maple Grove Beach; and
WHEREAS, parking in this “Resident Only” area will be for residents living on Lots 37 through 45 of Maple Grove Beach Division #2 and Lots 32 through 36 of Maple Grove Beach and will not reserve any particular parking place within this zone for a resident; and
WHEREAS, in review of this matter, it was discovered that a
clerical error was made in adopting sections of the model traffic ordinance in
Ordinance No. C-105-98; and
WHEREAS,
the regulation of traffic control
upon County rights of way is a function of the police power, properly
exercisable by the Board of County Commissioners; NOW, THEREFORE,
BE IT HEREBY ORDAINED by the Board of County Commissioners of
Island County, Washington, as follows:
1.
Parking
restrictions on Maple Grove Road shall be as shown on Exhibit “A”, and the
Island County Code is amended to read as shown on said exhibit. Underlined material is added to existing
county code and interlineated material is deleted.
2.
ICC
10.06.030 shall be as shown on Exhibit “B” and the Island County Code is
amended to read as shown on the said exhibit.
Underlined material is added to existing county code and interlineated
material is deleted.
SECTION 1 OF THIS
ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FIFTEEN DAYS FROM AND AFTER ITS
PASSAGE INTO LAW AND SECTION 2 SHALL BE IN FULL FORCE IMMEDIATELY.

10.02.010 Road Restrictions
CC.
Road
restriction—Maple Grove Road, Road Log # 86090, located in Section
23, Township 32N, Range 2 East.
1. From
the easterly boundary of Lot 32 of Maple Grove Beach northeasterly to North
Camano Drive, parking shall be prohibited on both sides of the roadway.
2. From
the westerly boundary of Lot 45 of Maple Grove Beach Division # 2 northeasterly
to the easterly boundary of Lot 32 of Maple Grove Beach, parking shall be
prohibited on the northern side of the road.
Parking on the southerly side of the road shall be limited to resident
parking only. Residents are prohibited
from parking recreational vehicles, and other large vehicles thereon. Residents are defined as those residing on
Lots 37 through 45 of Maple Grove Beach Division # 2 and Lots 32 through 36 of
Maple Grove Beach.
