ISLAND COUNTY COMMISSIONERS - MINUTES OF MEETING

REGULAR SESSION  -  DECEMBER 27, 1999

 

The  Regular Meeting of the Board of Island County Commissioners was held on December  27, 1999, beginning at 11:30 a.m. with  the monthly  Roundtable with Elected Officials,  followed by other  meeting items as listed on the Agenda beginning at 1:30 p.m., including Diking Improvement District #4.     The meeting  was held in the  Island County Courthouse Annex, Hearing Room, Coupeville, Wa., with  Mike Shelton, Chairman;  Wm. L. McDowell, Member; and  William F.  Thorn present. 

Roundtable Meeting with Island County Elected Officials

     Elected Officials:   Tom Baenen;  Mike Hawley, Maxine   Sauter;  Suzanne Sinclair;

            Peter Strow      

            Others:  Margaret Rosenkranz, Budget Director;  Caroline Morse, Prosecuting Attorney’s   Office  [Cathy Caryl  invited to attend today’s Roundtable but was unable to attend]

 

Technology Committee

 

Commissioner Thorn addressed the need for a county  technology committee, an advisory  committee to the Board.  It was his thought that this would be a  group of about 5 members  willing and interested in committing time and effort to look  into  the policy for technology as the County moves ahead,  define the relationships better,  work to resolve concerns each department has   and  point the County where it should go  in the future with technology.  A lot is in place, but it is incomplete.   A  beginning point would be to look at how the county does business, what are the interfaces needed and how does that come  together through the technology, and  “how do we do business in Island County?”.  He sees this as  something that in the long run will be a  stabilizing influence for the county and provide assistance to the Board in looking at where the county needs to go.  

 

Commissioner Shelton thought the committee a perfect idea but suggested it would be a mistake to  focus only on immediate problems.  Limiting the size of the committee is a good idea, but saw a need for representation from the appointed departments, in addition to  Cathy Caryl or her representative.

 

Other pointed brought up by Elected Officials and Commissioners included: 

 

·        the need to look  at how  this technology is used throughout the county in all aspects

·        a need early on for a  survey of non-County based systems used by County offices

·        identify restrictions  [access to records/confidentiality issues]

·        prioritization issues

·        look at other systems,  not just counties, but  some business models as well, to see how they handle customers and interface with others.

JUVENILE SERVICES CONTRACTS FOR DETENTION

 

As presented and explained by John Deremiah, Interim Juvenile Services Administrator, the

Board by unanimous motion approved Contact RM-JUV-99-0103  between Whatcom County and Island County, and Contract RM-JUV-99-0097  between Snohomish County and Island County, both Juvenile Detention Service Agreements, at a cost of  $90,.00 per day per  juvenile placed in juvenile detention facility.

Staff Session Schedule Issued for January, 2000

 

The Board, on unanimous motion, approved for distribution, the January 2000 staff session schedule, with regular staff sessions to be held on January 5 and 19, beginning at 9:00 a.m.

 

Application for Liquor License #082251-4I Brierly Inn B & B, Clinton

 

On review of said application, the Board received favorable recommendations from Island  County staff, the Board approved application for liquor license #082251-4I for Brierly Inn  B&B, Clinton.

The Board, by unanimous motion, approved Interagency Agreement between the State  Department of Ecology and Island County, a  Coordinated Prevention Grant (Solid Waste)

No. G0000140, in the amount of $100,000 [local share $53,846]; contract effective for two years.

 

Interagency Work Order Agreement Amendment- DSHS – STATE  Incentive Grant for Substance Abuse Prevention

 

By unanimous motion, the Board approved Interagency Work Order Agreement Amendment 1 to Original Work Order 6882 with the State  Department of Social & Health Services,  a  State Incentive Grant for Substance Abuse Prevention, in the amount of  $158,340.

 

HEARING HELD:  RESOLUTION #C-162-99 - Emergency in 1999 Fund budgets:  Current Expense Fund, Anti-Profiteering Fund, Equipment Rental & Revolving Fund, Guardian ad Litem Fund, Public Health Pooling Fund, Public Works Fund, Solid Waste Fund

 

A Public Hearing was held at 1:50 p.m.  as scheduled and advertised, to consider  Resolution #C-162-99, an emergency appropriation to the  following 1999 Fund budgets:  Current Expense Fund, $1,071,964; Anti-Profiteering Fund, $1,000; Equipment Rental & Revolving Fund, $193,500;  Guardian ad Litem Fund, $10,000; Public Health Pooling Fund,  $4,882; Public Works Fund, $6,283; and $7,667 for the  Solid Waste Fund [refer to Exhibit A of Resolution].

 

Margaret Rosenkranz, Budget Director, explained the emergencies in the various department funds were to recognize monies received not from State or Federal government, but have come to the County that have or will be spent in the 1999 budget year, with the exception of Commissioners Contingency which is recognizing use of unreserved fund balance.

 

No one in the audience spoke either for or against Resolution #C-162-99.

 

By unanimous motion,  the Board  approved Resolution #C-162-99.

               WHEREAS,  it appears that an emergency (legislative definition) exists in the following 1999 Island County Fund budgets that could not be foreseen when those budgets were adopted;  Current Expense Fund, Anti-Profiteering Fund, Equipment Rental & Revolving Fund, Guardian ad Litem Fund, Public Health Pooling, Public Works Fund and Solid Waste Fund , and

 

               WHEREAS, additional funding sources have been identified for various projects and expenditures for these Funds per the Attached Exhibit A, and

 

               WHEREAS,  funds need to be recognized in the Current Expense Fund budgets $1,071,964, Anti-Profiteering Fund budget $1,000, Equipment Rental & Revolving Fund budget $193,500, Guardian ad Litem Fund budget $10,000, Public Health Pooling Fund budget $4,882, Public Works Fund budget $6,283, and Solid Waste Fund budget $7,667 to cover these expenditures,  and

 

               WHEREAS, RCW36.40.140 requires that a public hearing be held at which any person may appear and be heard for or against this proposed emergency appropriation, NOW THEREFORE

 

               BE IT RESOLVED, that a public hearing be held at the hour of 1:50 p.m. on the 27th day of December 1999, at the usual meeting place of the Board in Coupeville to consider this proposed emergency appropriation to the 1999 Island County Current Expense Fund budgets, Anti-Profiteering Fund budget, Equipment Rental & Revolving Fund budget, Guardian ad Litem Fund budget, Public Health Pooling Fund budget, Public Works Fund budget,  and Solid Waste Fund budget, per the attached Exhibit A.

HEARING HELD:  Resolution #C-163-99- Supplemental Appropriation

to 1999 Island County Fund Budgets

 

A Public hearing was held as scheduled and advertised, following action on Resolution  #C-162-99 above, to  consider Resolution #C-163-99, a  Supplemental Appropriation to the following 1999 Island County Fund Budgets:  Current Expense Fund, Alcohol/Substance Abuse Fund, Developmental Disabilities Fund, Public Health Pooling Fund, Solid Waste Fund,

as described in Exhibit A.

 

As Mrs. Rosenkranz commented, the purpose of the supplement is to recognize State or Federal funding and application of those funds.

            WHEREAS,  the State of Washington has awarded funding for the CADA/STOP Grant ($12,500), and the Child Enforcement Grant ($1,825) for the 1999 Current Expense Fund, Prosecutor’s 1999 budget,  and

 

            WHEREAS,  the State of Washington, Department of Agriculture has amended the Spartina Control Contract for the 1999 Current Expense Fund, Weed Control budget in the amount of $35,000,  and

 

            WHEREAS,  the U.S. Department of Justice has awarded equipment funding to Island County for the 1999 Current Expense Fund, Sheriff budget in the amount of $11,142,  and

 

            WHEREAS,  the State of Washington has awarded Litter Control funding to Island County for the 1999 Solid Waste budget in the amount of $11,500,  and

 

            WHEREAS,  the State of Washington has awarded various Grant funding to Island County for the 1999 Public Health Pooling Fund budget ($93,088), the Alcohol/Substance Abuse Fund budget ($25,000) and the Developmental Disabilities Fund budget ($60,000) in the amount of $11,500,  and

 

            WHEREAS,  there is a need to recognize these monies to allow expenditures in excess of the 1999 budgets heretofore authorized by the Board of Island County Commissioners as shown on Exhibit A; and

           

            WHEREAS, RCW36.40.100 requires that a public hearing be held prior to adoption of supplemental appropriations;  NOW THEREFORE

 

            BE IT RESOLVED, that a public hearing be held at the hour of  1:50 p.m. on the 27th day of  December 1999, at the usual meeting place of the Board in Coupeville to consider these proposed supplemental appropriations.

HEARING HELD:  Ordinance #C-161-99 Establishing Fees

 for Juvenile Diversion Services

 

A Public Hearing was held at 1:55 p.m. as scheduled and advertised, to consider Ordinance   #C-161-99, establishing fees for Juvenile Diversion Services.

 

John Deremiah recalled that the proposed ordinance was reviewed at staff session  with the Board on December 6.  Adopting the proposal l will  allow for establishment of fees to cover  costs of administration and operation  of juvenile diversion services, a fee not to exceed $50,

there is the ability to waive fees in the event of hardship [Federal poverty guidelines used to set a reduced rate or to waive fees].

By unanimous motion,  the Board approved Ordinance #C-161-99 establishing fees for Juvenile Diversion Services.

DIVERSION SERVICES                    )

 

     WHEREAS, Island County is required by law to provide diversion services for juveniles accused of certain offenses; and

 

           

WHEREAS, the Island County Juvenile Court Services diversionary unit incurs expenses in administering the juvenile diversion program; and

 

            WHEREAS, the Board of County Commissioners is authorized by Chapter 171, Session Laws of 1993, to establish fees to cover the costs of administration and operation of diversion services provided under RCW 13.40.085, which chapter also requires the parent or legal guardian of a juvenile who receives diversion services to pay for the services based on the parent’s or guardian’s ability to pay; NOW, THEREFORE,

 

            BE IT ORDAINED by the Board of Commissioners of Island County that the Juvenile Court shall establish fees to cover the costs of the administration and operation of diversion services provided under RCW 13.40.085, as set forth on the attached Exhibit “A”, which is incorporated into the Island County Code.

 

            BE IT FURTHER ORDAINED that the effective date of the enforcement of this ordinance shall be December 31, 1999.

 

     Reviewed this 6th day of December, 1999, and set for public hearing on the 27th  day of December, 1999 at 1:55 p.m.   in the Commissioners’ Hearing Room.
