Board of Island County Commissioners (including Diking Improvement District #4)
met in Regular Session on May 15, 2000, beginning at 9:30 a.m., held in the
Island County Courthouse Annex Hearing Room, Coupeville, Wa., with Wm. L. McDowell, Chairman, William F. Thorn, Member, and Mike Shelton, Member, in attendance.

under Resolution #C-48-00 Proclaiming Recognition and Special Observance of Armed Forces Week, May 14 through 20
“Saluting America’s Best”.

WHEREAS, May 14 -20 designated
as Armed Forces Week,
celebrates the 50th anniversary of Armed Forces Day and provides a special opportunity to
demonstrate the unity and common purpose of the Armed forces in
fulfilling national security requirements; and
WHEREAS,
millions of American men
and women have answered the call to duty in defending the hard-won freedoms all
of us enjoy today, and continue to do
so; and
WHEREAS, recognizing
today and since 1942 the
strong strategic presence of Whidbey Island Naval Air Station Oak Harbor, Island County,
Washington; and
WHEREAS,
Navy personnel presence and absence is felt so completely in this community,
whether it be the surge of pride and excitement when a plane flies by or the
concern we feel when Navy personnel are
deployed. Our Naval personnel are
valued, involved members of Island County.
NOW THEREFORE, BE IT RESOLVED by the
Board of Island County Commissioners that the week of May 14 – 20, 2000, is
Armed Forces Week in Island County, Washington and all citizens encouraged to participate in the
celebrations with the theme "SALUTING
AMERICA'S BEST".

CONTRACT #HD-02-00 APPROVED
By unanimous motion, the Board approved Contract
#HD-02-00 with Hayes Drilling, Inc.,
for Site Hazard Assessment, NTE, in the amount of $12,000, as discussed early
March and approved by the Board of Health on
March 20th.
Island
County Eelgrass Survey – Award of $25,000
Don
Meehan, WSU Extension Agent, first reported on a very successful Penn Cove
Water Festival, and thanked everyone
involved who made it all come together.
He introduced Terry Stevens, Director, Padilla Bay
Interpretive Center, also one of the main movers on the Northwest Straits
Commission. The contract before the
Board through Department of
Ecology funding is a grant through the
Northwest Straits Commission, and Mr. Stevens, along with local MRC members
Gary Wood and Mike Gallion, awarded symbolically $25,000
to the County for a project
identified by the local MRC, underwater
videography eelgrass mapping and also using
Beachwatchers to do a citizens’ survey of the nearshore
environment.
By
unanimous motion, the Board approved
CZM310 Grant Agreement #G0000312 between Island County and the
Washington State Department of Ecology for Island County Eelgrass Survey, in
the amount of $25,000.

By
unanimous motion, as recommended by Larry Kwarsick, Public Works Director, and
Lew Legat, County Engineer, the Board approved and signed Standard Consultant Agreements as follows:

HEARING
HELD: Ordinance #C-42-00
(R-20-00) - Vacation- portion
of County road R/W known as Humphrey Road
A
Public Hearing was held at 10:20 a.m. as scheduled and advertised, for the
purpose of considering Ordinance #C-42-00 (R-20-00) in the matter of vacation of portion of County
road right-of-way known as Humphrey Road located in Section 36 Township 29N.,
Rge. 3E, W.M., petitioned by David & Janet Sonnichsen and Ben Kosa.
Mr.
Legat advised that the County had been
deeded the right of way in 1913 as part of the Clinton to Glendale road
#72; eventually the right of way was replaced by the present location of
Humphrey Road [shown on map posted on
the wall during the hearing]. A vacation
of a portion of the right of way was done in 1990. A greater area had been proposed for vacation at that time but
only one property owner was willing to compensate the County for the right of
way, now there are two others who have come forward.
Public
Hearing notice was posted in the field as required, along with notice in the
paper of record as well as South Whidbey Record. The County Road Department supports the vacation for the
following reasons:
1.
This portion is no longer publicly traveled
2.
The road has been replaced by the Humphrey Road
alignment
3.
Vacation will
return the right of way to the tax roles
4.
The right of way is disconnected from the
present right of way hence not suitable for future expansion.
5.
In contacting the Whidbey Trails Council the
County was advised that the Council did not feel the right of way was suitable for
a trail since it was a dead end and preferred something adjacent to the
existing right of way.
As
required by ICC 12.03.020, Mr. Legat reported that the classification of the road right of way proposed to be
vacated is: Class B, no public expenditures made or
non-ascertainable from records; and sub-class
1 and 6 - no part thereof lies
in a plat, abandoned in fact due to relocation of R/W. Petitioners
have been contacted and notified
with regard to the requirement for compensation to the County. The appraised value as determined by the
Assessor’s Office is: $3,800-David and
Janet Sonnichsen parcel; $767 - Ben
Kosa parcel. The Engineer
recommended approval of the vacation upon
receipt of compensation which includes the value of the land and
administrative costs. Once that occurs,
he will return to the Board to confirm same and present for the Board's
approval and signature the Final Order of Vacation.
Petitioners
were not present at the hearing. At the
time the Chairman called for public comments, no one in the audience expressed
support or opposition to granting said vacation.
By unanimous motion, the Board approved vacation of that portion of County Road right-of-way known as Humphrey Road located
in the Southeast Quarter of Section 36, Township 29 North, Range 3E, W. M.
petitioned by David and Janet Sonnichsen and Ben Kosa; when the final dollar figures are established and the
Engineer confirms receipt of payment, the Board will approve and sign the Final Order of Vacation.
DISCUSSION: State Revolving Fund Loan Agreement-Washington State DOE for West Beach Lake Acquisition
The
matter of Resolution (R-21-00) Executing State Revolving Fund Loan Agreement between Island County and
Washington State DOE for West Beach
Lake Acquisition through a loan in the amount $408,200, was presented to the
Board, tabled from last week’s meeting.
Last week a question was raised relative to the Conservation Futures Fund and the Fund’s ability to
fulfill some envisioned year 2000 obligations and what impact there would be on
that fund should the loan not be accepted.
In an e-mail message Mr. Kwarsick included a revised spread sheet
demonstrating that kind of action was
feasible, although it would weaken the Fund’s capacity for the next several
years to provide opportunities for
future purchases of open space land.
He mentioned that should the Board not accept the Iverson
Loan there would be significant and
serious impact to that Fund’s ability
to acquire not only the Natoli property
but any property for quite some time.
Chairman
McDowell acknowledged that the public
hearing concerning the Resolution regarding a loan for purchase of the Iverson
property would be held on June 5th; he believed conditions for that loan were reasonable but not for the
West Beach Lake acquisition and preferred not moving forward with the loan for a
number of reasons as previously discussed, another is his dislike of the idea
of continuing to borrow long term because it decreases any future Board’s
ability to react to requests.
Commissioner
Shelton recommended letting this
loan go and move forward with other
loan agreements [Iverson Property and the On-site Repair Financial Assistance
Program], and pay for West Beach Lake out of Conservation Futures Fund, concurring with the
Chairman to keep Conservation Futures on a more current basis.
Commissioner Thorn liked staying on a cash basis and given the analysis, supported that as
well.
No
action on proposed Resolution #R-21-00.
RESOLUTION

The Board, by unanimous motion, approved Resolution
#C-49-00 (R-23-00) approving Plans
and Specifications and authorizing Call for Bids for Asphalt Concrete
Pavement (ACP) Overlays on Camano Island, under CRP #00-03, Work Order #357, setting bid
opening date for June 7, 2000 at 11:00 a.m., Meeting Room 3, Courthouse Annex,
Coupeville.

Asphalt Concrete Pavement Overlays, Camano Island; NOW THEREFORE,
BE IT HEREBY RESOLVED that the Plans
and Specifications are approved and that the County Engineer is authorized and directed to call for bids for
furnishing said construction. Bid
Opening is to be the 7th day of June 2000, at 11:00 a.m. in Meeting
Room 3, Courthouse Annex, Coupeville.

Planning Director, and Jeff Tate, Planning Manager, introduced Ordinance
#C-50-00 [PLG-013-00] In the Matter of
Amending the Island County Zoning
Atlas, ICC 17.03 and the Comprehensive Plan Future Land Use Plan Map to comply
with the Order of the WWGMHB relating to Freeland and Clinton, requesting that
the Board schedule same for a public hearing.

Monthly
Financial Reports from Auditor & Treasurer
Suzanne
Sinclair, Auditor, was present at the time of the reports; Maxine Sauter,
Treasurer, was not present but submitted a
written financial report for the period ending April 30, 2000 under cover Memorandum dated May
9. Ms. Sinclair handed out the
Auditor’s report dated May 12, 2000.
Some
of the comments noted were that District Court and Jail revenues seemed to be lagging behind somewhat; on the
other hand, there were some increases in sales tax and investment
interest. There is believed to be a
revenue loss of some $200,000 to $210,000 in the Budget due to sales tax equalization because that had come from
M-VET funding.
With no further business to come before the
Board, the meeting adjourned at 11:05 a.m., with the Board to meet again in
Regular Session on May 22nd at 11:30 a.m.
