The Board of Island County Commissioners (including Diking Improvement District #4) met in Regular Session on May 7,  2001 beginning at  9:30 a.m. in the   Island County Courthouse Annex, Hearing Room, Coupeville, Wa., with    Mike Shelton, Member; and Wm. L. McDowell, Member, present;  Chairman, Wm. F. Resolution #C-63-01 - Amend Operations &  Procedures Section Resolution #C-79-99 for Marine Resources Committee

 

As presented and recommended for approval  by Don Meehan, WSU Extension Agent, the Board by unanimous motion approved Resolution #C-63-01 to Amend Operations and Procedures Section Resolution #C-79-99 for the Island County Marine Resources Committee, to provide that the Marine Resources Committee shall recommend a representative to the NW Straits Commission to be appointed by the Board of Island County Commissioners.

WHEREAS, the Board of Island County Commissioners adopted Resolution #C-79-99 on June 28, 1999 establishing Operations and Procedures for the Island County Marine Resources Committee (MRC), and;

 

WHEREAS, Operations and Procedures of the Marine Resources Committee need to be amended;

 

NOW, THEREFORE, BE IT RESOLVED, that the Board of Island County Commissioners does hereby replace resolution C-79-99 Marine Resources Committee Operations and Procedures Exhibit “A” Section Leadership para 4 with;

 

MRC shall recommend to the Board of Island County Commissioners a member representative to represent the local MRC on the NW Straits Commission to the Board of Island County Commissioners .  The Board of Island County Commissioners shall appoint the member a representative to the NW Straits Commission.

VOLUNTEERS OF AMERICA - Dispute Resolution Center

Contract #RM-BOCC-99-0027 renewal

 

Betty Kemp, Director, GSA, presented with a recommendation of approval, the Dispute Resolution Center Contract RM-BOCC-99-0027 renewal for the period of          1/1/01-12/31/02 related to performance of dispute resolution duties as specified in Exhibit A, Scope of Work.  The fee schedule is provided under Attachment “B”.  Inasmuch as Island County Code 2.29.010 established a competitive solicitation for service contracts that exceed $15,000.00, in this case  because of timing and a limited number of agencies who can perform the same type service for the County, she asked that the  Board  waive the bid requirements under ICC 2.29.030 (B) (12). 

 

By unanimous motion,  the Board approved and signed the Dispute Resolution Center Contract RM-BOCC-99-0027 renewal for a two year period to  12/31/02, and waived the bid requirements under ICC 2.29.030 (B) (12). 

 

Quit Claim Deed - STATE  DNR  Rhododendron Park Property

 

Lee McFarland, Assistant Director, GSA/Property Management Division, appeared before the Board to present for the Board’s acceptance and approval, a quit claim deed to Island  County for the State DNR [Department of Natural Resources]  Rhododendron Park Property in fee, consisting of some approximately 160 acres  under DNR’s Trust Land Transfer Program, including the campground,  at no cost to Island County, subject to the County agreeing to retain and manage the property for  its intended use.  There is no money involved between Island County and the State DNR in this transfer of property to Island County, and it is Mr. McFarland’s understanding  that the State will pay the recording fee.  Mr. McFarland will discuss at a subsequent staff session any budget impacts as far as part time assistance during summer months, and proposals to off set those costs.

 

By unanimous motion, the Board accepted and approved the Quit Claim Deed from the State of Washington, Department of Natural  Resources, #RM-PARK-00-0081 for the State DNR Rhododendron Park Property, a portion of Section 2-T31N-R01E, Tax Parcel Numbers:  R13102- 066-2001, R13102-199-1991, R13102-200-2981, R13102-288-284, R13102-330-2001, R13102-418-1410.

 

Lease Agreement for STATE DNR Elger Bay  Property

 

Mr. McFarland presented  for the Board’s acceptance and approval, a Lease Agreement for the State DNR Elger Bay Property located on Camano Island, a 30 year lease at no cost to the County, under  DNR’s Trust Land Transfer Program. 

 

By unanimous motion, the Board approved Lease Agreement with State of Washington Department of Natural Resources, 1999-2001 Trust Land Transfer Lease Agreement #61-072857.

 

Assumption of Liquor License #357256-3E, Whidbey Market

 

Having received recommendations of approval from the Sheriff’s Office and the Health Department, the Board by unanimous  motion, approved Assumption of Liquor License #357256-3E, for Whidbey Market.

 

Resolution #C-64-01 Authorizing a Temporary Two-Day Closure Island County Treasurer’s Office

 

The Board, by unanimous motion, approved Resolution #C-64-01 Authorizing a Temporary 2-day Closure Island County Treasurer’s Office on May 14 and 15, 2001, due to remodeling and renovation of the Island County Courthouse.

            WHEREAS, the Call of Bids for remodeling/renovation of the Island County Courthouse project bid opening is scheduled for April 5, 2001; and

 

            WHEREAS, according to the current relocation schedule, the public portion of the Island County Treasurer’s office, will be moving from the Island County Courthouse to the Main Street Building located at 400 N. Main Street, Coupeville, WA.; and

 

            WHEREAS, the Island County Treasurer has requested permission to close the office for those two days, Monday, May 14, 2001 and Tuesday, May 15, 2001, working days when the Office is ordinarily open to the public; and

 

            WHEREAS, closing of the office would allow better service to the public by being organized and open again rather than attempting to work with makeshift systems prone to error or loss; and

 

            WHEREAS, RCW 36.16.10 states that “All county and precinct office shall be kept open for the transaction of business during such days and hours as the board of county commissioners shall by resolution prescribe,”;  NOW THEREFORE

 

            BE IT HEREBY RESOLVED that the Board of Island County Commissioners authorizes closure of the Island County Treasurer’s Office during the time of relocation from the Island County Courthouse to the Main Street Office Building located at 400 N. Main Street, Coupeville, WA., on May 14 and 15, 2001.

Resolution #C-65–01 (R-22-01)  -  Approving Plans &  Specifications and Authorizing Call for Bids for Glendale Road Maintenance AND  Repair Project

 

Larry Kwarsick, Public Works Director, presented for approval,  Resolution #C-65–01 (R-22-01) Approving Plans and Specifications and Authorizing Call for Bids for Glendale Road Maintenance and Repair Project, CRP  [County Road Project]  97-04,  W.O.   [Work Order] # 236.   Dick Snyder, Assistant County Engineer, explained that this primarily involved the upper canyon area and the installation of a retaining wall along with  storm drain system and some pavement repair and guardrail upstream from where the culvert will be installed.

Resolution #C-66 -01 (R-25-01) – In the Matter of Amending CRP 97-04(C)

 

The Board, by unanimous motion, approved Resolution #C-66-01 (R-25-01) in  the Matter of Amending CRP 97-04(C), W. O. #236, relating to Glendale Road Maintenance and  Repair Project  [BICC 01-303].

 

Resolution #C-67-01(R-23-01)  Initiating CRP 01-03-construction

Terry’s Corner Park & Ride Facility

 

The Board, on unanimous motion, approved as presented and recommended by the Public Works Director,  Resolution #C-67-01(R-23-01) Initiating CRP 01-03, W.O. #289, dealing with various planning studies and projects associated with  Terry’s Corner involving the Park and  Ride Lot,  as well as engineering studies and evaluations leading up to the modifications to  intersections and also the signalization at Terry’s Corner.

 

Dick Snyder confirmed that this project was not causing other projects to slide.  His time is  involved  for the project rather than using any  design staff or construction engineering, on managing the project.

 

Resolution  #C-68-01(R-24-01) –  Adopting Revisions to Island County Real Property Right-of-Way Procedures.

 

The Board, by unanimous motion, adopted Resolution #C-68-01(R-24-01) adopting revisions to  Island County Real Property Right-of-Way Procedures, an update to an existing document as required by State and Federal funding to reflect current staff and personnel associated with right of way procedures.

WHEREAS, on the 22nd day of December 1997 by Resolution R-62-97 the Board of County Commissioners adopted Real Property Acquisition and Right of Way Procedures (“Procedures”); and

WHEREAS, said procedures are in need of modification to include reference to RCW 8.08 which provides authority to the Board of County Commissioners to condemn land and property within the county for public use whenever the county commissioners deem it necessary; and

 

            WHEREAS, said procedures are in need of modification to include reference to RCW 36..85.010 which provides authority to the Board of County Commissioners to secure land by gift, purchase or condemnation for any road or drainage thereof; and

 

            WHEREAS, there is a need to modify Exhibit “A” of said Procedures to provide an updated listing of Island County staff filling real property acquisition positions; and

 

            WHEREAS, there is a need to modify Exhibit “B” of said Procedures to increase the maximum dollar limit to waive the requirement for an appraisal;

 

NOW THEREFORE, BE IT HEREBY RESOLVED that the Real Property Acquisition and Right of Way Procedures adopted by Resolution R-62-97 are modified as to incorporate RCW 8.08 AND RCW 36.85.010 follows:

 

The first paragraph of the Procedures is revised to read as follows:

 

Island County, a political subdivision of the State of Washington, (“COUNTY”) desiring to acquire Real Property in accordance with the STATE OF WASHINGTON (“STATE”) Uniform Relocation and Real Property Acquisition Act (Ch. 8.26 RCW), Acquisition-Condemnation (RCW 36.85.010), Condemnation authorized for general county purposes - Petition (Ch. RCW 8.08) and state regulations (Ch. 468-100 WAC) and applicable federal regulations hereby adopts the following procedures to implement the above statutes and Washington Administrative Code.  The Public Works Department of the COUNTY is responsible for the real property acquisition and relocation activities on projects administered by the COUNTY.  To fulfill the above requirements the Island County Public Works Department will acquire real property and right-of-way in accordance with the above referenced laws, codes, regulations and  policies, and the policies set forth in the Washington State Department of Transportation Right of Way Manual (M 26-01) and Local Agency Guidelines Manual

(M 36-6).  The COUNTY has the following expertise and personnel capabilities to accomplish these functions:

ISLAND COUNTY, a political subdivision of the State of Washington, (“COUNTY”) desiring to acquire Real Property according to 23 CFR, Part 635, Subpart C and WASHINGTON STATE (“STATE”) directives and desiring to take advantage of the $10,000.00  appraisal waiver process approved by the Federal Highway Administration for Washington State, hereby agrees to follow the procedure approved for Washington State Department of Transportation (“WSDOT”) as follows:

 

RULES:

A.     The COUNTY may elect to waive the requirement for an appraisal if the acquisition is simple and the compensation estimate indicated on the PROJECT FUNDING ESTIMATE (“PFE”) is $10,000.00 or less including cost-to-cure items.

 

Note:  This Resolution supersedes any conflicting conditions in the Procedures and all other conditions of the Procedures which have not been modified or superseded by this Resolution are ratified and shall remain in full force and effect.

Asphalt Concrete Overlays

 

By unanimous motion, the Board approved Interlocal Reimbursable Agreements for asphalt concrete overlays as follows, under contract as part of  Island County’s  paving, subject to re-signature of the two Mayors   after corrections as requested by the Deputy Prosecuting  Attorney: 

 

#C-69-01 (R-26-01) Interlocal Agreement between Island County and Town of Coupeville for  Asphalt Concrete Overlays in an amount not to exceed  $20,000, under  CRP 01-01, W.O. #358  [BICC 01-299]

 

C-70-01 (R-27-01) Interlocal Reimbursable Agreement between Island County and City of Langley for  Asphalt Concrete Overlays in an amount not to exceed  $74,000, under  CRP 01-02, W. O. #358.[BICC 01-300]

 

Bid Award Recommendation for Asphalt Concrete Materials

 

Bid Award recommendation for Asphalt Concrete Materials for the  period May, 2001 to May, 2002 as provided by the Public Works  Director and County Engineer, was accepted by the Board by unanimous motion, awarding bid to the low bidder for Mod. Class G, Class B and ATB to Lakeside Industries for Whidbey and Camano Road Shops, and with Tack Coat Oil bid awarded to Lakeside Industries for Whidbey Road Shops, and to  CSR Associated for the Camano Road Shop.

 

Bid Award Recommendation -  Liquid Asphalt Materials

 

As recommended by the Public Works  Director and County Engineer, the Board by unanimous motion, awarded  bid to the low bidder for Liquid Asphalt Materials for the period May, 2001 to May, 2002, to  Chevron Products Company.  The listed products include two Palmer products to be used on a trail  basis  this year.

 

Supplemental Agreement #4  to Consultant Agreement #PW-992025   Drainage Study for Holmes Harbor Sewer District

 

The Board, by unanimous motion, approved Supplemental Agreement #4  to Consultant Agreement #PW-992025 with  Datum Pacific for Drainage Study for Holmes Harbor Sewer District related to on-going work within the Holmes Harbor, for time extension to April 30, 2002, and change in scope to include a third outfall at the northerly end of the project, with total  amount of agreement increased by $30,000.

 

Island County & Washington State Department of Transportation Participating Agreement GCA 2754

 

The Board, by unanimous motion, approved Island County & Washington State Department of Transportation Participating Agreement GCA 2754 [PW-012012] involving a joint effort with three local governments and the State for  SR 532 Route Development Plan update, with Island County’s contribution $20,000.

 

Contract/Bond/Retainage Bond – Callen Construction

Co., Inc.; East Camano Drive, Phase 2

 

By unanimous motion, the Board approved contract with Callen Construction Company, Inc., and accepted /Bond/Retainage Bond associated with  East Camano Drive, Phase 2  project on

Camano Island, in the amount of  $1,195,071, under  CRP 96-05.

 

Contract/Performance Bond – Island Asphalt;

Whidbey Island pavement repairs

 

The Board by unanimous motion, approved Contract and accepted Performance Bond [SP22470670] from  Island Asphalt associated with  Whidbey Island pavement repairs, in the amount of $38,692.35.  The contract was developed using the small works roster process and is a pilot project involving pavement dig-outs [one road in each of the three districts district on Whidbey Island this year as a pilot project; another contract to follow at the next meeting for Camano Island].

 

Contract/Performance Bond/ Retainage Bond – Hanson Brothers Construction, Inc.; Island County Courthouse Expansion & improvement Project Phase 2

 

Mr. Kwarsick presented for approval a  Contract and Payment Bond submitted by  Hanson Brothers Construction, Inc., the firm awarded the bid on April 16, 2001, for the  Island County Courthouse Expansion and  improvement Project Phase 2,  in the amount of $2,131,885.59  (including sales tax), roughly about  $222,000 less than the next lowest bidder.    The contract has been reviewed by Risk Management and the Deputy Prosecuting Attorney.  Contract period is 210 days, so the completion date will be sometime after Christmas.

 

The Board, by unanimous motion, approved and signed the contract with Hanson Brothers Construction, Inc., and accept the Payment and Performance Bond, in the amount of $2,131,885.59  [BICC 01-308].  David L. Jamieson, Jr., Chief Deputy Prosecuting Attorney, sent a memorandum to the Board dated May 4, 2001, with regard to  bid protests filed by other bidders, and Mr.  Kwarsick agreed to send a letter to the two contractors who submitted bid protests to notify them of the County’s final actions awarding the bid and approving the contract.  

 

PROFESSIONAL Service/CONSULTANT  Contract –  Environmental Works COMMUNITY DESIGN CENTER -  Coupeville Community

Mental Health Facility

 

As presented and summarized by Gary Ness, Construction Engineer, the Board by unanimous motion approved Professional Services/Consultant  Agreement #RM-PW-012018 between Island County and Environmental Works Community Design Center for  architectural design services associated with the Community Development Block Grant [CDBG 00-64020-008] and design of the  Coupeville Community Mental Health Facility, in an  amount not to exceed  $56,290.00, with end date December 31, 2002  [BICC 01-309] .

 

Resolution #C-71-01 (SW 05-01) –  Authorizing Procurement of

General Services for Educational Purposes

 

As provided by Dave Bonvouloir, Solid Waste Manager, the Board by unanimous motion approved Resolution #C-71-01 (SW 05-01) in the matter of Authorizing Procurement of General Services-Educational Purposes, initiating the RFP process for school education programs K-12 for Waste Reduction, Recycling, and Household Hazardous Waste.

WHEREAS, funds are available in the Solid Waste FUND for the procurement of services of an Education Specialist to provide programs to public and private schools serving Island County residents,

NOW THEREFORE, BE IT HEREBY RESOLVED that the attached Terms & Conditions and Scope of Services are approved as written and that Director of Public Works and/or the Solid Waste Manager is authorized and directed to obtain competitive proposals for providing Island County with said services.
