The Board of Island County Commissioners (including Diking Improvement District #4) met in Regular Session on December 9, 2002, at 9:30 a.m. in the Law & Justice Facility, Department III (Courtroom 3), 101 N.E. 6th Street, Coupeville, Wa. Mike Shelton, Chairman; Wm. L. McDowell, Member, and William F. Thorn, Member, were present. By unanimous motion, the Board approved and signed the minutes from the meeting of December 2, 2002.
VOUCHERS AND PAYMENT OF BILLS

Don Mason, GSA, reported that on further investigation by the Service
Officer the claim has been withdrawn without prejudice.

Chris Cram was selected as Employee of the Month for November. Chris is
a Juvenile Probation Officer and
handles cases both on Whidbey and Camano Islands, is adept at working apart from the main office without
the usual administrative support, and is a
willing volunteer.
SPECIAL RECOGNITION
Carla Grau-Egerton, Juvenile
Court Services, successfully completed the Facilitation Skills Training
course for the National CASA Volunteer Training. The training was pursued
on her own and will allow her the
capability to train Island County
CASA volunteers which will be an invaluable asset to Island County and
the CASA program.

By majority motion, Commissioner Thorn abstaining, the Board clarified
that the appointment of Mike Shelton to
the LEOFF Board effective January 3, 2003 was for a two year period as
specified in RCW 41.26.110.
Contract
– I-COM EM03009 Amendment A - e911 Operations FY2003
By unanimous motion, the Board approved Amendment A
to Contract #EM03009 between Island County and I-COM [RM-BOC-02-0064] adding $ 40,250
for E911 Operations FY2003 representing
funding provided through the
Washington State Military Department for Enhanced 911 Operations.
The Board by unanimous motion, having received confirmation of approval
by the Sheriff, approved Liquor License 084644-3D, Camano Plaza Texaco, a
correction to the previously-approved license to add an applicant.
Claim for Damages by PSE in the amount of $2,179.19 was presented by
Betty Kemp, Director, GSA, confirming recommendation of approval from Risk
Management and Public Works Department.
Jack Taylor, Maintenance Superintendent, confirmed damage which occurred
as a result of County work when a
primary cable was cut with a backhoe in spite of calling before hand. Although
the Commissioners did not dispute the claim, they did ask that Mr. Taylor go back to PSE to review and provide
an explanation on the cost breakdown
attached to the claim, specifically the line item shown under labor reflecting
$162.64 straight time for 1.00 hours.
Claim rescheduled for consideration on December 16, 2002.
Claim
for Damages R02-12A by Krieg Construction, was presented by Ms. Kemp under
memorandum dated December 3, 2002, recommending approval in the amount of
$3,809.53, as a result of Island County
Sheriff’s patrol vehicle collision with claimant’s truck.
By unanimous motion, the Board approved Claim for Damages R02-12A by Krieg Construction, in the amount of $3,809.53, as recommended.
As presented and recommended for approval by Bill Oakes,
Public Works Director, the Board by unanimous motion approved the following

Atlas, as introduced November 4, 2002 and set for hearing [GMA #7293]. Phil
Bakke, Planning & Community Development Director, and Jeff Tate,
Assistant Director, reviewed with the
Board the proposed technical corrections
to Zoning Atlas Maps 57, 593 and 594
under this Ordinance as outlined
in Mr. Tate’s memorandum of October 29, 2002
attached
as Exhibit A to the Ordinance.
These corrections are technical in nature, errors on the maps as
typically pointed out by property owners.

WHEREAS, on September 28 and 29,
1998, the Board adopted the County’s GMA Comprehensive Plan and Development
Regulations; and
WHEREAS, by Ordinance C-123-98, the
Board also adopted Chapter 17.03 ICC as Island County’s official Zoning Code to
implement its GMA Comprehensive Plan with the Zoning Atlas as the Official
Zoning Map of Island County; and
WHEREAS, certain technical
amendments to the Future Land Use Plan Map and the Zoning Atlas have been
identified to ensure that the zoning designations are consistent with the
County Wide Planning Policies.
NOW, THEREFORE, IT IS HEREBY
ORDAINED
that the Board of Island County Commissioners hereby adopts certain technical
amendments attached hereto as Exhibit A to the Island County Zoning Atlas
(Exhibit C to Ordinance C-123-98).

SUBJECT: Technical corrections to the Zoning
Atlas
Attached is a set of maps for your review as
technical corrections to the Zoning Atlas.
Please refer to the following list of map numbers and associated
explanations of why these changes are being considered.
Map #57 – BLA /02 has been submitted which will
adjust the south property line of parcel R13112-394-2940 which currently
extends slightly beyond the south side of Welcher Road. The adjustment that has been requested will
result in the south property line of parcel R13112-394-2940 being consistent
with the road. This technical
correction is requested because the common parcel line that is shared between
parcel R13112-394-2940 and R13112-303-3300 is also a zone boundary between the
Rural Agriculture and Rural Forest Zone.
Map #593 and 594 – CUP 09-75 granted approval for a
gravel pit on parcels R23307-445-3150, R23307-355-3150, R23307-510-3800,
R23307-360-3800, R23307-450-2100 and R23307-510-2320. When the Zoning Atlas maps were adopted not all of the above
parcels were indicated as mineral lands of long term commercial
significance. All existing gravel pits
were supposed to be provided this designation.
This technical correction will make the Zoning Atlas maps consistent
with CUP 09-75 and C-93-99 that identified those parcels that were to be
established as mineral lands of long term commercial significance.

As scheduled and advertised, the Board held a public
hearing for the purpose of considering
five
open space applications:

OPS # 382/02 – Kevin Demaray, requesting 18.1 acres be
reclassified from Designated forest to Timber Land current use
classification. Parcel R22902-048-4410 located
on South
Whidbey Island, WA.
· OPS #383/02 - Thomas E. Killion, requesting one parcel with 9 acres and another parcel with 10 acres be reclassified from Designated forest to Timber Land current use classification. Parcel R23321-097-4290 and R23321-097-4950 located on North Whidbey Island, WA.
· OPS #380/02 - Mildred M. Anderson c/o Linda Anderson, requesting 11.88 acres be reclassified from Designated Forest to Timber Land current use classification. Parcel R32903-312-3372 located on south Whidbey Island, WA.
· OPS #381/02 - Margaret Buckley, requesting 8.04 acres be reclassified from Designated Forest to Timber Land current use classification. Parcel R22902-048-5110 located on South Whidbey Island, WA.
· OPS #337/02 - N. Douglas Sheppard/Sheppard Family L.P., requesting four parcels of 10.12 acres each be reclassified from Designated Forest to Timber Land current use classification. Parcel R23020-037-1000, R23020-037-1670; R23020-104-1020 and R23020-104-1680 located on Central Whidbey Island, WA.
All of the applications received a recommendation of approval as outlined in Island County Planning & Community Development Staff Reports in each case, subject to conditions noted therein and attached as a part of the open space agreement to be signed by the County and Applicant. These are reclassification’s from Designated Forest to Timber Land, not new designations.
Reece Rose, Clinton, questioned what affect the changes in classification would have on taxes. Mr. Tate explained that the dollar figure would not change whether in Designate Forest or Open Timber. There are State laws that have to be followed as far as how the land is managed and timber management plans still have to be met under State guidelines. As noted by Mr. Tate, the reason the change is requested for the most part is in order for the property owner to be able to short plat land in 5 acre parcels.
