The Board of Island County Commissioners (including Diking Improvement District #4) met in Regular Session on August 11, 2003, at 9:30 a.m. in the Law & Justice Facility, Department III , 101 N.E. 6th Street, Coupeville, Wa. Members William J. Byrd and Mike Shelton, were present; Wm. L. McDowell, absent. The meeting began with the Pledge of Allegiance. By unanimous motion, the Board approved meeting minutes from 8-4-03.

RESOLUTION #C-78-03/PLG-018-03 INCORPORATING THE
SERVICE AREA FOR THE THUNDER RIDGE ESTATES WATER SYSTEM INTO THE ISLAND COUNTY
CWSP AND ANNEXATION OF PARCEL INTO WATER SYSTEM SERVICE AREA
Jeff Tate, Assistant Director, Planning & Community Development, presented a recommendation to approve Resolution #C-78-03/PLG-018-03 Incorporating the service area for the Thunder Ridge Estates Water system in to the Island County Coordinated Water System Plan (CWSP) and annexation of Parcel #S6345-00-01019-0 into the Water System Service Area. The water system currently serves the Plat of Thunder Ridge; the subject parcel is located across E. Camano Drive and existing well is very close to an existing septic system and drainfield; Thunder Ridge Estates Water System is able to provide them with water thus allowing the well to be abandoned. There are no other service areas this would conflict with. Although there are a number of other things going on in Thunder Ridge Estates at this time, Mr. Tate was of the opinion this action would not affect other issues related to Thunder Ridge. The Department recommends the Board’s approval.

WHEREAS,
the Thunder Ridge Estates Water System was lawfully established prior to the
adoption of the Island County Coordinated Water System Plan; and
WHEREAS, the Thunder Ridge Estates Water System is currently approved to serve all 168 lots within Division #1 and Division #2 of the plat of Thunder Ridge; and
WHEREAS, the Thunder Ridge Estates Water System is proposing to incorporate their existing service area into the Island County Coordinated Water System Plan; and
WHEREAS, parcel S6345-00-01019-0 is not located within the plat of Thunder Ridge but is unable to continue using their existing well due to its proximity to an existing septic drainfield; and
WHEREAS, parcel S6345-00-01019-0 is not large enough to locate a new single family residential well on site and must seek water from another location; and
WHEREAS,
the Thunder Ridge Estates Water System is proposing to annex parcel
S6345-00-01019-0 into their water system service area; and
WHEREAS,
pursuant to WAC 197-11-800(4)(b) appropriations of 2,250 gallons per minute or
less of ground water are exempt from SEPA review, NOW, THEREFORE,
BE IT RESOLVED by the Board of Island County Commissioners that the Thunder Ridge Water System service area, including annexation of parcel S6345-00-01019-0, is hereby incorporated into the Island County Coordinated Water System Plan.

Dawn Thomas, Deputy Treasurer, was selected as the Employee of the Month for July. Dawn normally works on tax adjustments, but recently volunteered to take on added duties while that office was short of personnel, gained additional skills and understanding of the office.
Sheriff
Hawley presented the Lifesaving Medal
to Deputy Lane Campbell relating to his
actions in June of this year by stopping a would-be-bridge jumper from killing
himself, a hero who saved the man’s life.
The Board, by unanimous motion, reappointed Robert VanDeen and Sue Roundy to serve on the Central Whidbey Historic Presentation Advisory Committee for four year terms expiring August 13, 2007.

RESOLUTION NO. C-79-03
WHEREAS the Washington State
Legislature has provided funds for a program of community based services for youths through the Washington State
Department of Social and
Health Services, Juvenile Rehabilitation Administration, and
WHEREAS the Board of County
Commissioners believes participation in such a program would benefit Island
County and its youth and families, and
BE IT RESOLVED that the
Board of County Commissioners for Island County intends to participate in a
community corrections program and to make application for funds available under
the Consolidated Contract. Michael S.
Merringer, Administrator, Juvenile and Family Court Services, is authorized to coordinate, certify and
make submissions of claims for reimbursement to the Washington State Department
of Social and Health Services, Juvenile Rehabilitation Administration. Application will
not be made to replace county funds for existing programs.

As presented and recommended for approval by Lee McFarland, Assistant Director, GSA/Parks, the Board by unanimous motion approved the following Use & Occupancy Agreements:

Joan Govedare, Langley, advised the Board about the change in deadline from August 14 to August 11 to comment on siting the SBX in Everett. She attended a meeting in Everett with the attorney for a group of concerned Everett citizens a few weeks’ ago who said that if important entities such as the Board of County
Commissioners let the U.S. Army Space and Missile Defense Command know they are willing to litigate it may very well have the power to influence them not to choose Everett as their site, and she encouraged the Board to do so.
Dr. John Hurd, Clinton, noted the new response deadline for comments on the FEIS, and provided a copy of his latest e-mail to the Board with a draft FEIS response letter for the Board to review with the Island County Prosecuting Attorney, which would supplement the Board’s July 21 and August 4 letters expressing concerns about the siting of SBX in Everett. He asked that the Board today send an e-mail on the subject, including willingness to file litigation should the Everett site be chosen.
Linda Morris, Langley, brought up concerns having to do with health issues related to SBX siting in Everett, a very new and powerful technology, and yet to be proven that it will not harm adults and other kinds of life, and most importantly, children. There is concern too that siting the SBX in Everett would have an adverse affect on tourism in Island County once people hear about potential health risks.
Antoinette Marcus, Langley, expressed concerns with radar systems such as this, knowing how delicate a balance there is. A major concern too is that North Whidbey Island is the western-most point for United States military protection and she would hate to see anything interfere with Naval Air Station Whidbey communication.
Malcomb Ferrier, Langley, agreed with comments of Linda Morris with respect to affects of radiation on common cells particularly young developing cells, known to be greater in children. He felt there should be a major study to determine exactly what the affects are. He stressed too that just not enough is known about it; too many unknowns.
Heidi Olman, Freeland, talked about the radar installation near Cape Cod and concerns there; and also quoted researcher Robert O. Becker, M.D. [Air Force Base, San Antonio] who expressed concerns about effects that the SBX may have on citizens, particularly ELF electromagnetic fields, impaired cellular growth and increasing cancer rates. This type radiation has never been tested and they are finding near these facilities raised levels of breast and lung cancer as well as rare cancers.
Lori O’Neal, Clinton, submitted a letter of comment for the record, and displayed what she described as an artist’s conception of what the SBX facility in Everett would look like. She shared with the Board some of the history she is learning from information obtained from the Army library in Texas, and also a 1984 document by Air Force Captain Paul Tyler. While the Air Force continually informs citizens that radar is no more harmful than sitting under a light bulb, she believed there was no question of grave danger. What she is learning raises serious alarm and she hoped Island County would make threat of legal appeal today.
Chris Leonard, Langley, commented on NEPA, it’s dedicated purpose and Congress’ declaration of the policy of the Federal government. His point being with regard to the proposed SBX siting in Everett, and that at least there should be a supplemental EIS due to flaws in the process and having not included Island County. He went on to lay the groundwork of what was necessary before litigating. He asked today that the Board go a step beyond the July 21 and August 4 letters and request that a proper EIS scoping procedure be followed that includes Island County or that the process start over including Island County, and that if neither happens, that Island County plans to litigate.
Fred Geisler, Langley, asked that the Board adopt an emergency resolution objecting to the SBX installation.
Commissioner Shelton made the point that the Board wrote two letters directed to the people in charge of placing the SBX in Everett. Generally, the things discussed today could be summarized in three major areas: health affects of SBX may be adverse to beings and the environment; SBX radar installation impact on the mission of NAS Whidbey Island; and process/procedure issues. The mission of NAS Whidbey is clearly is a grave concern to Island County and the Board very much supports the mission of NAS Whidbey and want to ensure that that mission is in no way impacted. Island County was omitted in the process even though the EIS shows that Whidbey Island would be impacted by the SBX being located in Everett. The issues covered in the Board’s letters give the Board an opportunity to have standing, assuming the Army wants to locate the SBX in Everett; therefore he was unwilling at this point to state a
threat of lawsuit. If the Army decides to locate the SBX in Everett, the Board will meet with legal counsel and make a determination at that time. The City of Everett indicated they will litigate and at this point the Board of Island County Commissioners has submitted the two letters to the Army acknowledging all of the issues addressed today.
Commissioner Byrd agreed that Commissioner Shelton had covered everything quite well. In conversation with Rick Larsen’s Office he passed on the comments of Island County citizens and the Board. Congressman Larsen’s Office has been in touch with the two Senators on this issue as well. He agreed that the Board has the opportunity to take action later on to make any determination on legal course of action.
Commissioner Shelton added that from a process point of view, it did not include notification to Island County and that point is addressed in the Board’s letters. Should the Army go forward with the siting in Everett, the Board will consult with legal counsel. Island County’s concerns are very valid and he hoped the Federal government would choose to locate the SBX elsewhere.
There being no further business to come before the Board at this time, the meeting adjourned at 10:47 a.m. The next regular meeting will be held on August 18, 2003 beginning at 9:30 a.m.
