BOARD OF ISLAND COUNTY COMMISSIONERS  MINUTES OF MEETING

SPECIAL SESSION  -  JULY 6,  2004

 

The Board of Island County Commissioners met in Special Session on Tuesday, July 6, 2004, beginning at 2:00 p.m. at the Island County Camano Multipurpose Center, 141 N. East Camano Drive, Camano Island.  William J. Byrd, Chairman, Wm. L. McDowell, Member, and Mike Shelton, Member, were present. Dick Snyder, Island County Engineer,  represented the Public Works Department; two members of the public were present.   An attendance sheet was circulated and has been placed on file with the Clerk of the Board. 

 

The purpose of the special session was to conduct a public hearing on Resolution #C-63-04/R-22-04,  Final Order of Vacation by Petitioner A. David Strauss, et. al., for a portion of County Road right of way known as Edgewater Drive, located in the Plat of Double View, Division No. 1, Section 3, Township 31 N,   Range 2 E., Camano Island.      

 

Mr. Snyder  explained  that Mr.  Strauss petitioned the Board of County Commissioners to vacate a portion of Edgewater Drive in February 2004 and in March of 2004 the Board directed the County Engineer to make a report on the requested vacation.  The report of the County Engineer was in favor of the proposed vacation of the south 67 feet of Edgewater Drive between Lots 16 and 15 [owned by the petitioner, Mr. Strauss] in the plat of Double View since it would not affect the County transportation system. The  Public Works Department concurred in that recommendation.  Mr. Snyder noted that Edgewater Drive did not go through to the plat of Rockaway Beach to the south and was not needed since Pleasant Lane connected the plats of Rockaway Beach and Double View.  He  clarified that Public Works had originally thought a drainage easement should be retained on the 67 feet [vacation portion], but after further investigation, confirmed it was  not necessary.

 

No one indicated a desire to speak either for or against the proposed resolution and the Chairman closed the public testimony portion.

 

Commissioner McDowell asked if the owner of Lot 11 in Rockaway Beach had been  made aware of the proposed vacation and possible impact of the drainage water.  He also inquired whether drainage water would back up to Lot 17 if the ditches were filled in along the vacated portion and wanted clarification whether the road was constructed in the portion to be vacated.  

 

Mr. Snyder indicated that applicant’s  petition had been circulated,  and confirmed that the County notified by mail nearby residents about the  proposed vacation.  He also confirmed that drainage water would not back up toward Lot 17 since there were no drainage ditches in that location.  He further explained that the slight amount of drainage water going south down the hill from Edgewater Drive draining onto Lot 11 in Rockaway Beach was minimal and went along a natural flow southerly and westerly toward the bluff.  The  runoff from Lot 17 went west westerly over the bluff.  Mr. Snyder advised that   Edgewater Drive was constructed for Lots 18 and 17, but was not constructed for Lot 16 where the road vacation was proposed.  Lot 15 would access from the other side along Double View Drive.  He pointed out in order to build a house, Lot 16 would need the vacated portion of the road to meet the setback requirements from the bluff.  

 

The Chairman clarified that Lot 16 was in the plat of Double View abutting Lot 11 in the plat of Rockaway Beach.

 

Answering Commissioner McDowell about the road Lot 11 would access from,  Mr. Snyder  stated that  Lot 11 would access from Pleasant Lane without any impact since it was an existing paved County road.

 

The Board, by unanimous motion approved Resolution #C-63-04/R-22-04 in the Matter of the Petition by A. David Strauss, et. al., for the Vacation of a portion of County Road right of way known as Edgewater Drive, located in the Plat of Double View, Division No. 1, situated in Section 3, Township 31 N, Range   2 E.

There being no further business to come before the Board at this time, the meeting adjourned at 2:10 p.m.  The Board will meet next in Regular Session July 12, 2004 beginning at 9:30 a.m.
