The Board of Island County Commissioners (including Diking Improvement District #4) met in Regular Session on July 10, 2006 at 9:30 a.m. in the Island County Courthouse Annex, Hearing Room, 1 N. E. 6th Street, Coupeville, Wa. Wm. L. McDowell, Chairman; William J. Byrd, Member, and Mike Shelton, Member, were present. The meeting began with the Pledge of Allegiance. By unanimous motion, the Board approved the minutes from regular session held on July 3, 2006.

By unanimous motion, the Board approved three WSU Extension Agreements as follows:

Resolution #C-75-06 Authorizing An Interfund Loan to the Island County Fair Fund

The Board by unanimous motion approved Resolution #C-75-06 Authorizing An Interfund Loan from the Island County Current Expense Fund to the Island County Fair Fund, to establish a revolving fund during the Island County Fair and to pay the expenses of the Fair during the year. Resolution #C-76-06 - Washington Wildlife & Recreation Program Farmland Preservation Authorizing Resolution

Resolution #C-76-06 In the Matter of Washington Wildlife & Recreation Program Farmland Preservation Authorizing Resolution, as proposed and submitted by Pat Powell, Executive Director, Whidbey Camano Land Trust was approved by unanimous motion of the Board, authorizing applications (1) Ebey's Reserve Farmland and (2) Smith Prairie Farmland for funding assistance for a Washington Wildlife and Recreation Program project to the Interagency Committee for Outdoor Recreation for acquisition of interest in real property for farmland preservation. EMPLOYEE OF THE MONTH - JUNE, 2006

John Bertrand, Island County Public Works/Planning, Employee of the Month for June, nominated by Linda Kast of Island Asphalt & Sitework, Inc. for helping her with a Clearing and Grading Permit. John was very through and courteous in the process and helpful in dealing with other questions that were not in his specific division, taking time to carefully explain what was needed and put her in touch with the right people to resolve her questions.

SPECIAL RECOGNITION

Res. Corporal Scott Fortin and Deputy Darren Crownover, received commendation for special lifesaving efforts performed in the line of duty, resulting in saving a North Whidbey woman by initiating and maintaining CPR. They were composed and professional, taking the situation in hand and doing what was needed without hesitation.

HEARING HELD: REQUEST BY Kevin Chambers for private construction of unopened County Right-of-Way known as Bells Ridge Lane and First Street located in the Plat of Bells Beach

At 10:15 a.m. as advertised, a Public Hearing was held on the matter of the request of Kevin Chambers to open an unopened County Road Right-of-Way for private construction of unopened County Right-of-Way known as Bells Ridge Lane and First Street located in the Plat of Bells Beach, Sec. 19, Twp 30N, R 3E.

Bill Oakes, Public Works Director, relayed the Department's recommendation of approval, subject to additional conditions of approval contained in Attachment "A" to the Application to Perform Work on County Road right of Way.

Jan Morton, property owner adjacent to Bell's Ridge Lane (Triangle piece shown on the map as 414), adjacent to the hammerhead, spoke in favor of the hammerhead emergency vehicle turnaround, but told the Board she would have liked to have had that option as well, and expressed concern about not having been notified about this action. The County denied them access off Bell's Ridge Lane because of heavy traffic and she wondered what had changed to now allow someone else to do so.

For the Morton's property, Mr. Oakes confirmed that the County authorized opening unopened county right of way for First Avenue to access their property. The County is interested in limiting the number of accesses onto Bell's Ridge Lane because it is a narrow road. For the parcels under consideration, there are no other practical alternatives for access as there was in the case of the Mortons. As spelled out in Attachment "A", the applicant does have to improve to standards the portion of the road in front of their property they are building. This is an old plat and existing lots.

Since the remainder of the road is not scheduled on the road plan for improvements, Commissioner Shelton suggested it may be something for Mr. Oakes to review.

By unanimous motion, the Board approved the request of Kevin Chambers to open an unopened County Road Right-of-Way for private construction of unopened County Right-of-Way known as Bells Ridge Lane and First Street located in the Plat of Bells Beach, Sec. 19, Twp 30N, R 3E. subject to the conditions.

Retainage Bond – Rinker Materials - 2006 Overlays – Camano Island

Retainage Bond between Island County and Rinker Materials West LLC dba Rinker Materials, was approved by unanimous motion of the Board, associated with the 2006 Camano Island Overlays contract signed July 3, 2006, CRP 06-01, Work Order No. 247.

Escrow Agreement – Krieg Construction, Inc. - Monroe Landing Road Improvements

Escrow Agreement between Island County and Krieg Construction, Inc. for Monroe Landing Road Improvements, CRP 02-03, Work Order No. 356, per contract signed July 3, 2006, was approved by unanimous motion of the Board.

STORMWATER MITIGATION AGREEMENTS AND COVENANTS

On presentation and recommendation of Mr. Oakes, the Board by unanimous motion approved the following Stormwater Mitigation Agreements and Covenants:

Phil Bakke, Planning & Community Development Director, presented for the purpose of scheduling for public hearing, Ordinance #C-77-06 (PLG-020-06) In The Matter Of An Ordinance Concerning Technical Amendments To The Island County Comprehensive Plan Future Land Use Plan Map And The Island County Zoning Atlas, Map #7, North Whidbey Island, Wa. Exhibit "B" to the Ordinance, a memorandum to the Board dated June 12, 2006, outlines the nature of the technical corrections to the Zoning Atlas having to do with BLA 281/05.

OPEN SPACE APPLICATIONS SCHEDULED FOR PUBLIC HEARING

The Board by unanimous motion, scheduled a Public Hearing on August 14, 2006 at 10:30 a.m. to consider the following Open Space Applications:

OPS 476/05 Applicants Mark & William Sande - 40 acres of land on Camano Island be enrolled into the timber land current use program. Parcel R23123-204-4700, Camano Island, WA.
