Minutes

Members Present: Commissioners: Mike Shelton, William J. Byrd and Mac McDowell; Barbara Saugen, WGH Commissioner; Patty Cohen, Mayor of Oak Harbor; Captain Susan B. Herrold, Commanding Officer of Naval Hospital Oak Harbor, Ex Officio Member; Roger S. Case, MD, Executive Secretary to the Board.

Call to Order: Chairman Mac McDowell called this Regular Session of the Island County Board of Health to order at 1:15 p.m.

Agenda: There were no additions or changes to the agenda.

Minutes: Barbara Saugen moved that the minutes for the February 13, 2006 meeting be approved as written. Mayor Cohen seconded and the motion passed for the Chair to sign on behalf of the Board.

New Business:

Community Health Advisory Board (CHAB)/Environmental Health Assessment Team (EHAT):

Barbara Saugen advised the Board that she had participated in interviews of the proposed new members and enthusiastically advised the Board of Health to approve the following appointments and reappointments:

Barbara Saugen moved that the appointments be made as presented. Mayor Cohen seconded and the motion passed unanimously.

Presentations:

I-901 Update – Dan Bond, Island County Health Department Human Services section, started by giving the Board background information regarding his experience with the I-901 process during his first 3-months as an Island County employee. He characterized that timeframe as mostly answering phone inquiries and advising establishments on the requirements. The process is now moving from information dissemination to the negotiation phase. He advised the Board that if establishments are willfully non-compliant, the County needs to have a process for dealing with willful non-compliance. The Health Department now has a 3-stage process for addressing this issue prior to the need for initiation of legal action. Dan is the Island County contact on the State’s list for anonymous complaints.

Dan distributed a sample packet, representative of what Island County establishments are receiving. Tim McDonald advised that Dan has put together "rebut" criteria and Tim and Dr. Case will review any "rebuts" that are received, noting that it is up to the establishment to prove that their situation upholds the principal of the law.

Physical Activity Program – Karen Grossman, Health Department staff, presented an overview of the history of the physical activity program in Island County. Department of Health encouraged Island County Health to apply for a grant to develop a County-wide plan for encouraging physical activity. Island County Health Department applied for and received the grant for planning to address physical activity and healthy nutrition. Carrie McLachlan, Health Department staff, spoke on how the community is being engaged in the plan. There have been some surprises in Island County. Older populations are exercising more than younger. All interviewed want more options for getting their exercise reporting a lot of personal barriers. Walking is the number one activity that the population will do. Commissioner McDowell suggested developing a brochure to advise people on where the trails are. Karen Grossman responded that trails maps had been done in the past and had been very popular. Mayor Cohen said she would be very willing to carry findings back to her Council to try to incorporate recommendations in the City of Oak Harbor’s developing path and trail way system.

Steve and Kathy Ivascenko Appeal:

Keith Higman, Environmental Health Director, outlined the staff recommendation regarding the Ivascenko appeal. The permit application was disapproved because there is insufficient horizontal setback to surface water as designed. Jim Weisner, speaking on behalf of the Ivascenko’s, told the Board that the Ivascenko’s only option thus far had been an appeal and suggested further meetings with staff to find a resolution. Commissioner Mike Shelton noted that it is not the staff’s responsibility to design the system and the Ivascenko’s will have to work with a licensed designer to look at their options. Commissioner Mac McDowell suggested that the appeal be continued to allow staff time to work with the Ivascenko’s. Commissioner Shelton moved that the appeal be continued for 90-days to the June 2006 Board of Health meeting, hoping for a satisfactory resolution removing need for the appeal. Mayor Cohen seconded and the motion passed unanimously.

Resolution C-30-06:

Tim McDonald presented Resolution C-30-06 to the Board: "In the Matter of establishing Island County Health Department fees for the "rebut" process and appeal process for the 25-foot minimum distance established by RCW 70.160.175". He advised that the fees for administration of the "rebut" process conform to other program area administrative fees. Commissioner Shelton moved for adoption of the Resolution. Commissioner Byrd seconded and the motion passed unanimously.

    Commissioner Shelton moved that Contract No. HD-11-06 in the amount of $ -0- be approved. Commissioner Byrd seconded and the motion passed unanimously.

  3. Snohomish Health District –Region 3 AIDS (2006)

Contract No. HD-10-06

Contract Amount: $ 50,800

Commissioner Shelton moved that Contract No. HD-10-06 in the amount of $50,800 be approved. Commissioner Byrd seconded and the motion passed unanimously

 Health Department Report:

Tim McDonald, Health Services Director asked the Board to consider Resolution HD-12-06 proclaiming the week of April 3, 2006 through April 9, 2006 Public Health Week in Island County in conjunction with the national public health week theme of "Designing Health Communities: Raising Healthy Kids". Barbara Saugen moved for adoption of the Resolution. Mayor Cohen seconded and the motion passed unanimously.

Tim McDonald reminded that Board that the annual joint meeting of the Board of Health and the Community Health Advisory Board would be held on April 4, 2006. This will be a Special Session of the Board of Health and will include the presentation of the 2005 Linda Lee Martens Health Hero awards. Director McDonald also advised the Board and audience that there was an opportunity to participate in a fund raising event benefiting the newly formed Coupeville Boys and Girls Club. Tickets purchased for a Mariachi band concert sponsored by Concerts on the Cove will benefit the Boys and Girls Club.

Public Input or Comments: There was no public input or public comment.

Adjourn: There being no further business, Commissioner McDowell adjourned the meeting at 2:55 p.m. The next Board of Health will be a Special Session held on April 4, 2006 followed by a Regular Meeting held on April 17, 2006.
