The Board of Island County Commissioners (including Diking Improvement District #4) met in Regular Session on July 3, 2006 at 9:30 a.m. in the Island County Courthouse Annex, Hearing Room, 1 N. E. 6th Street, Coupeville, Wa. Wm. L. McDowell, Chairman; William J. Byrd, Member, and Mike Shelton, Member, were present. The meeting began with the Pledge of Allegiance. By unanimous motion, the Board approved the minutes from previous meeting held on June 26, 2006.

VOUCHERS AND PAYMENT OF BILLS

The Board by unanimous motion approved the payroll dated June 30, 2006, along with the following pre-audited bills and vouchers:

COMMITTEE APPOINTMENTS AND REAPPOINTMENTS

On unanimous motion, the Board made the following appointment and reappointment:

Joint Administrative Board (Tourism) Appointment. Melanie Ford Bissey, Camano Island, refilling the vacancy left by the resignation of Kari Soth

Workforce Development Council - Reappointment. Mike Gallus, Freeland, representing the private business sector of Island County, for a three year term expiring July 27, 2009.

Request for Proposals – Primary Public Defender Contract

The Board considered submittal of a Request for Proposals (RFP) for the primary public defender contract, as submitted by Betty Kemp, GSA Director, under memorandum dated June 16, 2006.

Craig Platt, Craig Platt & Associates, Coupeville, asked that the Board not issue a RFP for the public defense contract; rather, consider extension of his current contract with appropriate modifications, as they have provided public defense services over the past 15 years for Island County. If a three year extension is unreasonable, he asked consideration of at least a two year term. He and his firm have done the best job possible representing clients, and hopefully, people realized how hard his office works. Two years' ago when the Board was asked to approve additional funding to cover technology costs, costs of physical plant and salary increases, promises he made at that time were delivered. The firm has substantial obligations; if the County goes out for bid, he was not sure he would be bidding because of the uncertainty of being awarded the contract. He has given 15 years of his life and asks in return for a two-year extension in order to give him an opportunity to sort things out and prepare, since he had not known there was a move afoot to go out for bid.

Chairman McDowell explained that going out for a RFP after a certain length of time is something the county and public deserve; all contracts eventually go out for a RFP, most reissued to the same contractor. After a contract running for 15 years, a RFP is something the public deserves, and this is no different than other County contracts. He has always been very pleased with public defense in this county and has had no concerns from a legal standpoint with public defense.

Commissioner Shelton told Mr. Platt he would be disappointed if he did not submit a RFP because of the 15 year track record given to the County. Two year's ago the Commissioners made a commitment to go out for a RFP at end of this last extension. If the RFP results in Mr. Platt not submitting a RFP he thought the whole process will not have served the people of Island County well.

Commissioner Byrd was appreciative of the hard work and dedication of Mr. Platt and did not recall any incident when there was a public defense problem, but the Board had two years' ago agreed that at the end of the last extension, the County would go out for bid.

By unanimous motion, the Board approved the Request for Proposals to Island County for Primary Public Defender Contract as presented.

Contract with Strategic Learning Resources – Pandemic Flu Public Education

As forwarded by Tim L. McDonald, Health Services Director, under cover memo dated June 28, 2006, the Board by unanimous motion approved Contract #HD-16-06 in the amount of $13,330.00 (RM-HLTH-06-0057) with Strategic Learning Resources to facilitate the Island County pandemic flu public education project.

LIQUOR LICENSE APPROVED

Based on receipt of a favorable recommendation from the Island County Sheriff, the Board by unanimous motion approved forwarding a recommendation of approval to the Washington State Liquor Control Board for the assumption of Liquor License #085937-3F from Frosty Bay Seafoods, Inc., d/b/a Brindle’s Market to Dyane L. & Thomas O. Mader, d/b/a Darby Food & Catering, business located at 848 N. Sunrise Blvd. #C, Camano Island.

Contract/Contract Bond – Rinker Materials West, LLC

As presented and recommended for approval by Randy Brackett, Assistant County Engineer, the Board by unanimous motion approved the Contract and Contract Bond #PW-0620-58 between Island County and Rinker Materials West, LLC, in the amount of $631,438.00 for the 2006 Camano Island Overlays project under CRP 06-01, Work Order 247.

Contract/Contract Bond – Krieg Construction, Inc.

In accordance with the recommendation of Mr. Brackett, the Board by unanimous motion approved the Contract and Contract Bond #PW-0620-66 between Island County and Krieg Construction, Inc. for the Monroe Landing Road Improvements under CRP 02-03, Work Order 356, in the amount of $1,508,661.25.

Resolution #C-74-06/R-25-06 – Initiating County Road Project CRP 06-02 - Contract Overlay – Whidbey Island

As recommended by Mr. Brackett, the Board by unanimous motion approved Resolution #C-74-06/R-25-06 In the Matter of Initiating County Road Project designated as CRP 06-02, Work Order 248 for the 2006 Contract Overlay – Whidbey Island.
