BOARD OF ISLAND COUNTY COMMISSIONERS
Public Hearing 

NOTICE IS HEREBY GIVEN that the Board of Island County Commissioners will hold public hearings in the Commissioners Hearing Room, Coupeville, Washington, 1 NE 6th Street, on November 2, 2009 at 10:15 a.m., to consider the following two ordinances.

C-120-09 [PLG-021-09], in the matter of adopting an Interim Official Control that regulates the use of property within the Freeland Municipal Urban Growth Area. The proposed ordinance reauthorizes the Freeland NMUGA interim development regulations addressing the following:

  1. Eliminates the potential for new uses to be established that are classified as non-conforming under the Freeland Sub Area Plan;
  2. Allows interim development only after it is demonstrated that the activity will not preclude future urban growth, uses, and infrastructure; and
  3. Goes into effect immediately and shall remain in effect for a period of six months, or as soon as permanent rules are adopted, whichever is earlier.

 C-121-09 [PLG-016-09], in the matter of amending Map # 219 of the Island County Zoning Atlas to rezone six parcels from Rural (R) to Light Manufacturing (LM) and correct the Urban Growth Area boundary.  The proposed ordinance brings the Island County Zoning Atlas into consistency with the Island County Comprehensive Plan.

THE GROWTH MANAGEMENT ACT

Designation of a New Zoning Classification Called, “The Camano Gateway Village Zone”.

On September 22, 2009, the Board of Island County Commissioners, through Ordinance

C-102-09 [PLG-015-09], adopted a new zoning classification called “The Camano Gateway Village Zone,” which amends The Island County Comprehensive Plan and Development Regulations for commercially zoned properties adjacent to State Route 532 on Camano Island. This Ordinance was adopted pursuant to the Growth Management Act, Chapter 36.70A RCW and more specifically RCW 36.70A.040. 

The Board of County Commissioners considered the recommendation made by the Planning Commission and further held public hearings on May 19, 2009 and September 22, 2009.

In 1998, Island County completed environmental review under Chapter 43.21C RCW, SEPA, on the Comprehensive Plan and Development Regulations. Pursuant to WAC 197-11-600, the County SEPA Official has determined that designation of the “Camano Gateway Village Zone” does not have a probable significant adverse impact on the environmental. A SEPA Threshold Determination of Non-Significance (DNS) was issued on November 6, 2008.

Any appeal of the above action alleging non-compliance with the Growth Management Act and SEPA must be commenced by the filing of a petition that includes a detailed statement of issues presented for resolution by the Board. The petition must be filed no later than November 25, 2009, or 60 days after the date of publication in the legal newspaper for Island County, with the following:

THE GROWTH MANAGEMENT ACT

Parcels Bisected by a Public Road Right-of-Way

In 1998, Island County completed environmental review under Chapter 43.21C RCW, SEPA, on its Comprehensive Plan and Development Regulations.  Pursuant to WAC 197-11-600, the County SEPA Official determined that the proposed changes to the Comprehensive Plan & Chapter 17.03 ICC, relating to the ability to divide land that is bisected by a public road right-of-way, were not likely to have significant adverse environmental impacts beyond those that were considered in the EIS & other supporting environmental documents prepared for the 1998 Comprehensive Plan & Development Regulations.

On November 10, 2008 the Board of Island County Commissioners, through Ordinance C-117-08 [PLG-016-08], adopted the Planning Commission recommendation to incorporate amendments to Chapter 17.03 Island County Code & the Island County Comprehensive Plan, as they pertain to parcels previously created as a result of division by a public road-right-of-way, all pursuant to the Growth Management Act, Chapter 36.70A RCW; specifically RCW 36.70A.040. This Ordinance exempted parcels bisected by a public road right-of-way from the minimum lot size and density requirements of the underlying zoning designation, all other regulations must still be met.

On May 15th, 2009 the Western Washington Growth Management Hearings Board issued a Final Decision and Order that Ordinance C-117-08 did not comply with the Growth Management Act, and the Ordinance was declared invalid.

On September 14, 2009 The Board of Island County Commissioners adopted Ordinance C-97-09 [PLG-014-09] striking the exemptions created by Ordinance C-117-08  from the Island County Comprehensive Plan and Island County Code in order to comply with the Growth Management Hearings Board  May 15th, 2009 Final Decision.

GMA Public Hearing 

NOTICE IS HEREBY GIVEN that the Board of Island County Commissioners will hold a public hearing on September 14, 2009 at 10:20 A.M. in the Commissioners Hearing Room, 1 NE 6th Street, Coupeville, Washington to consider Ordinance C-97-09 [PLG-014-09]. In the Matter of Adopting Revisions to the Island County Comprehensive Plan and Zoning Code to Comply with the Western Washington Growth Management Hearings Board Final Decision and Order Dealing With Property Bisected by a Public Road Right-of-Way.

 The Board of Commissioners adopted C-117-08 amending the Comprehensive Plan and Chapter 17.03 ICC, the Island County Zoning Code (“development regulations”), to allow parcels of property bisected by a public road right-of-way to be exempt from lot size and density requirements. An appeal of this ordinance was filed under 08-2-0032 challenging Island County’s Adoption of Ordinance C-117-08.

On May 15, 2009 the WWGMHB issued its Final Decision and Order finding that Ordinance C-117-08 did not comply with the Growth Management Act. In addition WWGMHB issued a finding of invalidity and required the County to take action to bring the Comprehensive Plan and Chapter 17.03 ICC into compliance with the GMA by September 18, 2009.

The Proposed Ordinance will strike the exemptions created by Ordinance C-117-08 from the Island County Comprehensive Plan and Island County Code as necessary to comply with the WWGMHB final decision.

NOTICE OF PUBLIC HEARING

              On July 6, 2009 at 10:20 a.m., the Board of Island County Commissioners will hold a public hearing at the Island County Annex Building, Commissioner’s Hearing Room, at 1 North East Sixth Street, Coupeville, Washington, to consider amendment of building permit fee schedule.

On February 4, 2008 the Board adopted Ordinance C-01-08 which amended Planning & Community Development building permit fee schedule but Island County’s fees have not kept up with inflation. In order for building permit fees to cover the increased costs of salaries, maintenance and operations, and, to be aligned with the actual costs of providing the service and commensurate with surrounding counties, the Board will consider amending the building permit fees.

Copies of the proposed amendment of the Planning & Community Development building permit fee schedule are available at the Planning & Community Development Department, Sixth and Main Streets, Coupeville and at the Camano Annex at 121 N.E. NOTICE OF PUBLIC HEARING

              On June 22, 2009 at 2:15 p.m., the Board of Island County Commissioners will hold a public hearing at the Island County Annex Building, Commissioner’s Hearing Room, at 1 North East Sixth Street, Coupeville, Washington, to consider amendment of land use permit fee schedule.

On June 23, 2008 the Board adopted Ordinance C-59-08 which amended that portion of the Planning & Community Development permit fee schedule that pertained only to implementation of the wetlands ordinance.  Land use permit fees have not been raised in more than 7 years and have not kept up with inflation.   The land use permitting process, supported by land use permit fees, benefits the common good.  In order for land use permit fees to cover the increased costs of salaries, maintenance and operations, and, to be aligned with the actual costs of providing the service and commensurate with surrounding counties, the Board will consider amending the land use permit fees.

THE GROWTH MANAGEMENT ACT
Revisions to the New CAO required to comply with the decision of the
Western Washington Growth Management Hearings Board

Island County’s new Critical Areas Ordinance (“New CAO”) was established through the adoption of Ordinance C-02-08, and technical amendments were made by Ordinance C-63-08. The adoption of the New CAO was appealed to the Western Washington Growth Management Hearings Board by WEAN and by CARE. The Western Washington Growth Management Hearings Board issued its Final Decision and Order on November 17, 2008; and found that revisions to C-63-08 were needed for three of the issues.

Pursuant to WAC 197-11-600, the Island County SEPA official has determined that the environmental impacts of the three revisions to the New CAO required to comply with the order of the Western Washington Growth Management Hearings Board are not likely to be significant.

The Board of County Commissioners considered a change in the recommendations made by the Planning Commission, which it incorporated after conducting a public hearing on May 4, 2009, adopting its own findings of fact and statement setting forth the factors considered at the hearing and its own analysis of findings considered by it to be controlling. On May 4, 2009 C-59-09 was adopted by the Board of Island County Commissioners accepting these revisions to the County’s New Critical Area Ordinance, Chapter 17.02A ICC, and a change to the Rural Stewardship Plan Worksheet to comply with the November 17, 2008 Order of the Western Washington Growth Management Hearings Board.

 6:30 P.M.  2. C-36-09 [PLG-005-09]. In the Matter of Adopting an Interim Official Control that Regulates Commercial Development within The Terry’s Corner and Camano Gateway Non-Residential Areas of Intensive Development.

The Board of Commissioners adopted the Official Control on April 1, 2009 and is required to hold a public hearing within 60 days of adoption. The Interim Ordinance addresses the same development regulations along the primary gateway to Camano Island and is intended to cover the short gap between the expiration of the previous interim Ordinance C-86-08 and the date the Board of County Commissioners takes final action on the amendments to the development regulations under consideration in the first hearing C-57-09 [PLG-004-09]. 

The new interim Ordinance enacts the majority of amendments to Chapter 17.03 ICC that have been suggested by the citizen group and the Planning Commission with the exception of whether gas stations, convenience stores, and overnight lodging should be allowed uses.

If adopted, the interim ordinance will go into effect immediately and shall remain in effect for a period of six months, or as soon as the evaluation and deliberation on amendments to the development regulations are completed and adopted by the Board, whichever is earlier.
